Terms of Service

These terms apply to your use of MemoirWell. If you do not agree with them, do not use the service.

Using MemoirWell

Use MemoirWell only for memories and materials you have the right to process. Do not use the service for unlawful, abusive, deceptive, infringing, or privacy-invasive activity. Paid purchases and refunds are handled through our Merchant of Record, Polar, without limiting any mandatory consumer rights that apply to you.

Minimum age (18+)

MemoirWell is intended only for adults. You must be at least 18 years old to create an account or use the service, and by signing up you confirm that you are 18 or older. We do not knowingly collect data from anyone under 18; if we learn that an account belongs to a minor we will close it and erase its data.

Your content

In short: your memories stay yours. We only use them to build your book.

You keep ownership of the memories, recordings, photos, transcripts, writing samples, chapters and text you provide or create. You grant MemoirWell a limited, non-exclusive permission to host, process, transcribe, generate, revise, export, secure and support that content only to provide the service and operate your account. If you invite collaborators or create a share grant, you authorize MemoirWell to make the shared parts of your project available to the people you choose, and you are responsible for who you invite; you can revoke an invitation or membership at any time. We do not sell your memories or use them to train AI models. You are responsible for having the rights and permissions needed for any third-party material or other people's personal information you submit or share.

AI drafts

In short: AI drafts can have mistakes — you're the author, so please check them.

Chapters, editorial outlines, and fact-check suggestions produced with our primary Anthropic-compatible prose provider or the DeepInfra text fallback are drafts. DeepInfra also independently processes the source and candidate text needed for safety, rejected-claim, and content-retention checks. AI output may contain errors. You remain the author and are solely responsible for reviewing facts, tone, permissions, names, and suitability before relying on, sharing, exporting, or showing it to collaborators. MemoirWell does not use your memories to train AI models.

No warranty

In short: the service is offered as-is, so please review your drafts before relying on them.

MemoirWell is provided on an as-is and as-available basis without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy of AI-generated text, or uninterrupted availability. AI drafts may contain errors and you are responsible for reviewing them before relying on or sharing them.

Limitation of liability

In short: there are limits to what we're responsible for, but your legal rights stay intact.

To the fullest extent permitted by applicable law, MemoirWell and its operator are not liable for indirect, incidental, special or consequential damages, or for loss of data, profit or goodwill arising from your use of the service. Nothing in these terms limits liability that cannot be excluded under Spanish or EU consumer law.

Payments, refunds and offers

In short: payments and refunds go through Polar, and you keep your consumer rights.

Paid plans are sold through Polar, which acts as the merchant of record and handles billing, taxes and receipts. There is no free subscription trial. The $39 monthly and $149 annual subscriptions are charged in advance at checkout and then renew automatically, with Polar charging the saved payment method at the start of each new monthly or annual period until canceled. You can cancel at any time through the Polar billing portal; cancellation stops the next charge and takes effect at the end of the billing period already paid for, with access continuing until then. The $499 one-time option is charged once and does not renew. Prices are in US dollars, and Polar shows the exact total and any applicable taxes before you confirm checkout. For any digital plan charge, including an initial subscription charge or renewal, you may request a full refund within 14 days of payment provided no book export has yet been generated; once a book export has been generated, the digital content or service has begun and that charge is non-refundable unless mandatory consumer law gives you a different right. Printed-copy ordering is currently unavailable and is not included in these digital plans. If printing is enabled in the future, print orders follow the print policy: no refund after proof approval, with a reprint or refund offered for production defects. Nothing in these terms limits any statutory right of withdrawal, legal guarantee or remedy for faulty digital content or services that cannot be waived under Spanish or EU consumer law.

Suspension and termination

You may stop using MemoirWell and close your account at any time. We may suspend or terminate access if you breach these terms or use the service unlawfully. On account closure we erase your content in line with the Data Retention policy. The sections on content ownership, liability and governing law survive termination.

Governing law and jurisdiction

In short: Spanish law applies, and your local consumer protections still count.

These terms are governed by the laws of Spain. Any dispute will be subject to the competent courts of Spain, without prejudice to any mandatory consumer-protection rights you may have in your country of residence under applicable law.
